General conditions of sale
1. Purpose and scope of application
These general terms and conditions of sale (GTC) govern the contractual relations between ABAYOU Paris, hereinafter referred to as the "seller", and any person making a purchase on the website www.abayou-paris.com, hereinafter referred to as the "customer". The GTC apply to all orders placed on the website www.abayou-paris.com.
2. Products
The products offered for sale on the website www.abayou-paris.com are women's abayas, sold new and in their original packaging. The photographs of the products presented on the website www.abayou-paris.com are as faithful as possible but cannot ensure perfect similarity with the product offered for sale, particularly with regard to colors.
3. Order
The customer has the possibility to place his order online on the website www.abayou-paris.com. The order can only be registered on the website www.abayou-paris.com if the customer has clearly identified himself by completing the online registration form. Any order placed by the customer constitutes irrevocable acceptance of these General Terms and Conditions.
4. Price
The prices of the products offered for sale on the website www.abayou-paris.com are indicated in euros including all taxes (TTC), excluding delivery costs. The seller reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time the order is registered.
5. Payment
Payment is made by credit card via the secure Stripe or PayPal system. The customer guarantees to the seller that he has the authorizations that may be necessary to use the payment method chosen when validating the order. The seller reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and level of execution, in the event of non-payment of any amount that would be due by the customer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the website www.abayou-paris.com.
6. Delivery
Delivery is made to the address indicated by the customer when ordering. The seller undertakes to deliver the products as soon as possible, except in cases of force majeure. Delivery costs are indicated when ordering and are the responsibility of the customer.
7. Right of withdrawal
In accordance with Article L. 221-18 of the French Consumer Code, the customer has a period of fourteen (14) days from receipt of the products to exercise his right of withdrawal, without having to provide a reason or pay a penalty. The products must be returned in their original packaging, complete, unworn and unused. The refund will be made as soon as possible and no later than fourteen (14) days from receipt of the products returned by the customer.
8. Guarantees
The seller guarantees the conformity of the products sold on the website www.abayou-paris.com with the regulations in force. In the event of non-conformity, the customer may request the replacement or refund of the product. The guarantee does not cover damage caused by non-compliant use or misuse of the products.
9. Intellectual property
All elements of the website www.abayou-paris.com, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of the seller. Any reproduction or use of these elements is strictly prohibited.
10. Personal data
The personal data collected from the customer is necessary for the management of his order and the commercial relationship between the seller and the customer. In accordance with the Data Protection Act of 6 January 1978, the customer has the right to access, rectify and oppose personal data concerning him. 11. Applicable law and disputes
These General Terms and Conditions are subject to French law. In the event of a dispute, the customer agrees to first contact the seller to attempt to amicably resolve any dispute relating to the execution or interpretation of these General Terms and Conditions. In the absence of an amicable agreement, any dispute relating to these General Terms and Conditions will be submitted to the competent courts.
